Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Architype mobile application, the website at myarchitype.com, and related services (the “Service”), provided by Fifteenth & Oak LLC (“Architype”, “we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Architype is a style-first architectural discovery platform. It lets you:

  • •Discover architectural styles by swiping through curated and user-submitted photos;
  • •Explore a map and heat map showing where architectural styles are concentrated;
  • •Contribute photos of architecture you spot (“Spotted Home” quick captures or detailed “Add to Architype” posts); and
  • •View your style profile built from your activity.

Architype is an informational and discovery tool. It is not a real estate, brokerage, appraisal, or professional advisory service, and nothing in the Service constitutes real estate, legal, financial, or architectural advice.

2. Eligibility and Accounts

  • •You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service.
  • •You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity under your account.
  • •You may sign up using email/password or Sign in with Apple.

3. User Content and Uploads

3.1 Your responsibility

“User Content” means anything you upload or submit, including photos, style tags, descriptions, ratings, location selections, and contact details. You are solely responsible for your User Content and represent that:

  • •You took the photo or have the right to upload it;
  • •Your User Content does not infringe anyone’s intellectual property, privacy, or other rights;
  • •You will only photograph architecture from publicly accessible vantage points and will not trespass, harass, or violate any person’s privacy to capture content; and
  • •Your User Content is accurate and not misleading (including style tags and location).

3.2 License you grant us

You retain ownership of your User Content. You grant Architype a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (e.g., to resize or reformat for display), display, and distribute your User Content within the Service for the purpose of operating, promoting, and improving the Service. This license continues for content that remains in the Service (for example, content others have interacted with) even after you delete your account, to the extent necessary for normal operation and backups.

3.3 Analysis and moderation

When you upload a photo, we send it to a third-party AI service to detect its architectural style and to flag potentially sensitive content (such as faces, license plates, or house numbers). This detection only flags content — it does not blur, mask, or otherwise alter your photo, and you should not rely on it to conceal sensitive information. You are responsible for what you upload. We may review, modify, restrict, or remove any User Content at our discretion, including content that violates these Terms or is the subject of a valid dispute.

4. Acceptable Use

You agree not to:

  • •Upload content depicting people in a way that harasses, endangers, or invades their privacy;
  • •Photograph private interiors or restricted areas without authorization, or trespass to obtain content;
  • •Upload content that is unlawful, infringing, defamatory, deceptive, or that misrepresents a property’s style, location, or ownership;
  • •Submit false location data or attempt to defeat the location-offset and privacy protections;
  • •Scrape, reverse-engineer, or bulk-extract content or data from the Service;
  • •Interfere with, overload, or attempt to gain unauthorized access to the Service or its providers; or
  • •Use the Service to identify, surveil, or target specific individuals or households.

We may suspend or terminate accounts that violate these rules.

5. Property Owner Disputes

If you are a property owner (or authorized representative) and an upload depicts your property, or if attribution or location is inaccurate, you may dispute the post using the in-app flag feature (e.g., “I am the homeowner and dispute this post”). We review disputes and may remove or modify content. Submitting a flag does not guarantee a particular outcome, but we will make reasonable efforts to honor legitimate owner-privacy requests.

6. Location and Heat Map

Location information shown in the Service is approximate by design — precise coordinates are offset before storage and we use city/region-level granularity. The heat map, style density estimates, and city profiles are generated from a mix of curated data, modeled estimates, and user submissions, and may be inaccurate or incomplete. Do not rely on the Service for any decision that requires precise or verified location, ownership, or property information.

7. Intellectual Property

The Service, including its software, design, branding, and curated content (but excluding User Content), is owned by Architype or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Third-Party Services

▸ The Service relies on third parties including Supabase (auth/database/storage), OpenAI (image analysis), Vibecode (AI gateway that routes our image-analysis requests to OpenAI), Expo (over-the-air app updates), Apple (Sign in with Apple), and Apple Maps. Your use of those features may be subject to the third parties’ own terms. We are not responsible for third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content (including style classifications, locations, or heat maps) is accurate, complete, or reliable.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCHITYPE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Architype from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

12. Termination

You may stop using the Service and permanently delete your account at any time from within the app (Profile → Delete Account), which removes your login, style profile, and uploaded content. We may suspend or terminate your access at any time if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive termination (including content license for residual content, disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to the Service and Terms

We may modify or discontinue features at any time. We may update these Terms; we will revise the “Last updated” date and, for material changes, provide notice within the Service. Continued use after changes take effect constitutes acceptance.

14. Governing Law and Disputes

▸ These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Maryland, and you consent to their jurisdiction.
